Children under the age of thirteen (13) years are not permitted to use the WHOSMAD™ website for any purpose, and we ask that such children not access or use this site in any way and do not provide us with any personal information. By using this website, you represent and warrant that you are over the age of thirteen (13) years.

 

Minors Between Thirteen (13) and Seventeen (17) Years of Age

Minors (in most USA jurisdictions, persons under the age of 18) must obtain the approval of a parent or legal guardian to use the WHOSMAD™ website and are not eligible to use this site or to provide us with any personal information without the supervision and approval of a parent or legal guardian. We ask that such minors not submit any personal information to us without such approval. By using this site unsupervised, you warrant and represent that either (1) you are eighteen (18) years of age or older; or (2) that you are between thirteen (13) years of age and seventeen (17) years of age and your parent or legal guardian has approved of such use.

This statement sets forth the WHOSMAD™ Privacy Policy and describes the practices which WHOSMAD™ follows with respect to information about you and other Users of this site.

 

For Users Who Post Material to Our Site

WHOSMAD.COM exists for the purpose of letting you blow off steam and, if you want, actually asking our other users to vote on whether you – or the guy/gal you’re angry at – is “in the right.” Aside from the possible legal ramifications of “going public” with your dispute (See our “Agreement on Terms & Conditions of Use,” of which this Privacy Policy is a part), there are some privacy-related matters you must understand and accept (and, by posting anything to this website, you do so understand and accept), among them, without limitation, the following:

 

1. Obviously, any personal, identifiable data that you may post with your Complaint on the WHOSMAD™ website will immediately become available to any user of our site. For example, if you post your address, phone number and photo, those items may become instantaneously available. WHOSMAD™ will not be responsible for, and expressly disclaims, any liability or consequences caused by your own divulging of your posted personal information. By posting any such information to the WHOSMAD™ website,




 

you agree to indemnify WHOSMAD™ and our Affiliates against any liability or expense (including all reasonable transactional and/or litigation-related legal fees) which might result from your posting of such information.

 

2. It is also possible that personally identifying information may inadvertently result from your posted material. For example, if you identify yourself as an author of children’s books “living in Springfield, AnyState,” the fact that there may be only ONE such person living in that community could serve to identify you whether or not you mean to do so. Therefore, there is some risk of being identifiable through almost any posting. WHOSMAD™ will not be responsible for, and expressly disclaims, any liability or consequences caused by your own divulging of such information. By posting anything to the WHOSMAD™ website, you agree to indemnify WHOSMAD™ and our Affiliates against any liability or expense (including all reasonable transactional and/or litigation-related legal fees) which might result from your posting of such information.

 

3. Further, the mere posting of the fact-situation about which you are complaining may, in certain circumstances, serve to identify you as the posting party. An example of this might be where you are complaining about having received a “pink-slip” from a certain named company (after all, part of your motivation will be to make clear exactly who the “other guy” is and what he/she did or didn’t do to anger you), and that company knows that the ONLY fired female employee was you. Once again, WHOSMAD™ will not be responsible for, and expressly disclaims, any liability or consequences caused by your own divulging of such information. You agree to indemnify WHOSMAD™ and our Affiliates against any liability or expense (including all reasonable transactional and/or litigation-related legal fees) which might result from your posting of such information.

 

4. Finally, later stages of the WHOSMAD™ Complaint-Response-Voting process may necessarily divulge certain information about you. During that process, you understand and agree that some of your personal information will, of course, be available to the “Defendant,” so that the Defendant can be aware of the situation you are referring to. Or, for example, the “Victory Dance” video that you may choose to send us – if it includes an actual image of you, or your dormitory room, or any other geographically or personally identifiable content – may serve to identify who you are. WHOSMAD™ will not be responsible for, and expressly disclaims, any liability or consequences caused by your own posting of such information or your causing of such information to be posted. You agree to indemnify WHOSMAD™ and our Affiliates against any liability or expense (including all reasonable transactional and/or litigation-related legal fees) which might result from the posting of such information.

Personal information

WHOSMAD™ may collect certain information from all users of this site. WHOSMAD™ may use this information for internal purposes (for example, to process transaction information or to send you updates about special offers, new products and special promotions). WHOSMAD™ may share contact information with its affiliated entities to enable them to provide you with special benefits, promotions, or offers from either WHOSMAD™ or its affiliates. In rare circumstances, we may disclose user information in the good-faith belief that disclosure is otherwise necessary or advisable including, without limitation, to protect the rights or properties of WHOSMAD™ or when we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights or properties, whether intentionally or otherwise, or when anyone else (including you) could be harmed by such activities. In addition, if WHOSMAD.COM, LLC, and/or substantially all of its assets are acquired, our user information will most likely be transferred to the acquiring party in connection with such an acquisition.

WHOSMAD™ may profile your activity on our website in order accurately to provide you with information, products and services that correspond to your special interests. WHOSMAD™ may also compile data in aggregate form so that we may better understand the users that are visiting our site. For example, we may produce reports on the most popular search terms by collecting general search term data based on individual searches. Aggregate data is anonymous and does not contain any personal information that identifies a user.

We will retain your personal information in our databases in accordance with our document management, retention and destruction policy, and applicable laws. This period may extend beyond the end of your relationship with WHOSMAD™, but it last only as long as it is necessary for us to have sufficient information to respond to any issues that may arise later. Security

WHOSMAD™ maintains a variety of physical, electronic and procedural safeguards to protect your personal information. For example, we use commercially reasonable tools and techniques to protect against unauthorized access to our systems. Also, we restrict access to personal information to those employees and agents who need to know that information in the course of their duties. IP Address Your Internet Protocol (“IP”) address is associated with the place from which you enter the Internet, like your Internet Service Provider, your company or your university.
